Positive Movement and a Movie in the Rivera Family’s Case whose 5 Children Were TAKEN by DCF

Fitchburg, MA – Isael “Izzy” Rivera and Ruth Encarnacion were back in Fitchburg District Court on August 28, 2025 where there was forward movement in their respective cases.
Rivera recently dismissed his court appointed attorney, retaining the Boston firm of Gens & Stanton for his defense.

Senior partner William Gens’ motion for a bill of particulars was granted by Judge Christopher LoConto. Once Attorney Gens has reviewed the details of the case he will be moving for dismissal of all criminal charges against his client.

 

Holden attorney Kevin Carl Larson motioned to have charges against Ruth Encarnacion dropped. His argument was taken under advisement. If Judge LoConto’s opinion has not been issued before September 23rd, Encarnacion will return to court for a bench trial.
